Online Learning Center Terms of Use

The Online Learning Center (OLC) is a means for continuous learning.  The OLC is intended to help build an educated and supported network.

 

We provide this tool so you can get advice, ask questions, get information about our school and our program, share experiences, and get support in your personal development.

 

We encourage our Students/Program Participants to visit and be treated by his/her healthcare professionals, including, without limitation, a physician. The Student understands that our faculty members are not acting in the capacity of a doctor, licensed dietician-nutritionist, psychologist or other licensed or registered professional.  Accordingly, the Student understands that the Academy is not providing healthcare, medical or nutritional therapy services and will not diagnose, treat or cure in any manner whatsoever any disease, condition or other physical or mental ailment of the human body.

 

The Student understands that the information received should not be seen as medical or nursing advice and is certainly not meant to take the place of seeing licensed health professionals.

 

Program participants acknowledge that they take full responsibility for thier life and well-being, as well as the lives and well-being of their family and children (where applicable), and all decisions made during and after this program.

 

The Student expressly assumes the risks of the Program, whether or not such risks were created or exacerbated by the Program. The participant releases the Academy, his/her hiers, executors, administrators and assigns, its officers, directors, shareholders, employees, teachers, lecturers, agents, health counselors and staff (collectively, the Releases) from any and all liability, damages, causes of action, allegations, suits, sums of money, claims, and demands whatsover, in law admiralty or equity, which against the Releases, the Participant ever had, no has or will have in the future against the Releases, arising from the Student's past or future participation in, or otherwise with respect to, the Program, unless arising from the gross negligence of the Releases.

 

CONFIDENTIALITY

 

The Student acknowledges teh Academy will keep all information exchanged during the program in strict confidentiality.  Additionally, the participant is aware that the Academy is prohibited from disclosing protected healthcare information, except upon written authority by the participant.

 

All Students/Program Participants are expected to keep all information exchanged on the OLC in strict confidentiality.  Non-compliance with this policy could terminate your use of the OLC and your participation at the Academy.

 

The Student expressly assumes the risks of posting personal information as part of an Online Learning Environment (OLE). The participant releases the Academy, his/her hiers, executors, administrators and assigns, its officers, directors, shareholders, employees, teachers, lecturers, agents, health counselors and staff (collectively, the Releases) from any and all liability, damages, causes of action, allegations, suits, sums of money, claims, and demands whatsover, in law admiralty or equity, which against the Releases, the Participant ever had, no has or will have in the future against the Releases, arising from the Student's past or future participation in, or otherwise with respect to, the OLE, unless arising from the gross negligence of the Releases.  

 

CHOICE OF LAW, ARBITRATION AND LIMITED REMEDIES

 

These Terms of Use shall be construed according to the laws of the State of N.Y. In the event that any provisions of the Terms are deemed unenforceable, the remaining portions shall be severed and remain in full force. In the event a dispute arises between the parties, either arising from this agreement or otherwise pertaining to the relationship between the parties, teh parties will submit to binding arbitration before the American Arbitration Association (Commercial Arbitration and Mediation Center for the Americas MEdiation and Arbitration Rules). Any judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. Such arbitration shall be conducted by a single arbitrator. The sole remedy that can be awarded to the Program Participant in the event that an award is granted in arbitration is refund of the Program Fee.  Without limiting the generality of the foregoing, no award of consequential or other damages, unless specifically set forth therein, may be granted to the Student.  

 

ONLINE LEARNING CENTER GREIVANCES

 

The OLC is not the place for airing greivances against other students or against the Academy. These types of greivances should be discussed directly with the Administrative Department at admin@eartheaven.org. Negative, derogatory or disrespectful posts can mar the experience of other students.

 

We reserve the right to edit or delete posts that are not in compliance with these terms of use.

 

We also reserve the right to terminate your usage of the OLC, as well as terminate your participation at the Academy for noncompliance with these terms.

 

In addition, we will remove posts from the OLC when they are outdated and/or no longer relevant, redundent, or applicable to one individual and not relevant to the group.
